Terms of Service Agreement

1. ACCEPTANCE OF TERMS

By accessing or using Fraud's services ("Services"), including but not limited to visiting the Fraud website located at fraud.best ("Website"), or adding the Fraud Bot ("Bot") to your Discord server, you ("User") hereby acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Agreement"). If you do not agree to these terms in their entirety, you are expressly prohibited from using the Services and must discontinue use immediately.

2. DEFINITIONS

In this Agreement:

  • "Fraud," "we," "us," and "our" refer to Fraud and its affiliates, directors, officers, employees, and agents.
  • "Services" means all products, features, applications, websites, or other services operated by Fraud.
  • "User," "you," and "your" refer to any individual or entity using our Services.

3. COMPLIANCE WITH LAWS AND DISCORD POLICIES

  • 3.1 The User shall comply with all applicable local, state, national, and international laws and regulations in connection with the use of the Services.
  • 3.2 User acknowledges that use of the Services is additionally subject to Discord's Terms of Service and Community Guidelines, and any violation thereof constitutes a violation of this Agreement.
  • 3.3 User shall promptly report any violations of applicable laws, regulations, or Discord policies to Fraud via email at contact@fraud.best.

4. PROHIBITED WEBSITE ACTIVITIES

User is expressly prohibited from engaging in the following activities in relation to the Website:

  • 4.1 Any attempt to exploit, hack, damage, disrupt, or gain unauthorized access to the Website or its systems;
  • 4.2 Any use of the Website for unlawful, fraudulent, or malicious purposes;
  • 4.3 Scraping, collecting, or harvesting any information from the Website for unauthorized purposes;
  • 4.4 Framing or mirroring any portion of the Website without prior written authorization;
  • 4.5 Copying, reproducing, distributing, or claiming ownership of any content, design elements, or proprietary information from the Website.

5. PROHIBITED BOT ACTIVITIES AND ENFORCEMENT

5.1 User is expressly prohibited from engaging in the following activities in relation to the Bot:

  • Violation of Discord's Terms of Service or Community Guidelines;
  • Reproducing, duplicating, copying, selling, or reselling any portion of the Bot's functionality;
  • Facilitating, enabling, or encouraging others to reproduce Fraud's services or features;
  • Exploitation of bugs, glitches, or vulnerabilities in the Bot's functionality;
  • Operation of a Discord server that has been previously terminated for policy violations;
  • Organizing, participating in, or encouraging harassment, "raids," or targeted attacks against Fraud or its staff;
  • Using the Bot to spam, harass, or otherwise abuse other Discord users or communities;
  • Attempting to reverse engineer, decompile, or extract source code from the Bot.

5.2 Enforcement Rights. Fraud reserves the right, at its sole and absolute discretion, to:

  • Terminate access to the Services, temporarily or permanently, with or without prior notice;
  • Remove, disable, or restrict the availability of any content;
  • Take appropriate legal action against Users who violate these terms, including without limitation, reporting such User to law enforcement authorities;
  • Pursue any and all remedies available at law or in equity for violations of this Agreement;
  • Investigate and prosecute violations of these terms to the fullest extent of the law.

5.3 No Waiver. Fraud's failure to enforce any right or provision of this Agreement shall not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Fraud.

6. REFUNDS AND ACCOUNT RESTRICTIONS

  • 6.1 In the event a User receives a refund under any circumstances, Fraud reserves the right, at its sole discretion, to blacklist said User's Discord account and permanently ban the User from accessing all Fraud Services.
  • 6.2 All refund requests must be submitted in writing to contact@fraud.best and will be evaluated on a case-by-case basis at Fraud's sole discretion.

7. LICENSE AND SUBSCRIPTION TERMS

7.1 Purchase of License. By purchasing a subscription or making a one-time payment for the Services, the User is granted a non-exclusive, revocable license to access and use the Services in accordance with this Agreement. This license is non-transferable, meaning it may not be assigned, sold, or otherwise transferred to another individual or entity. However, as outlined in Section 8, the User is entitled to one (1) free transfer of the Bot to a different Discord server. The Services are available either through a monthly subscription plan or a fixed one-time payment license, as specified at the time of purchase.

7.2 Agreement to Terms. The purchase or use of the Services, whether through a subscription or one-time payment, constitutes the User's explicit acknowledgment and agreement to be bound by all terms and conditions set forth in this Agreement. The User must comply with all provisions of this Agreement, including but not limited to Section 10 (Service Availability and Termination), as a condition of accessing and using the Services.

7.3 Free Services. If the Bot is offered as a free service, Fraud reserves the right to modify, suspend, or discontinue the free offering at any time without prior notice or liability to Users.

8. TRANSFERS

  • 8.1 Subscription Transfer Policy. Each User subscription includes one (1) free transfer of the Bot to a different Discord server. Any additional transfers beyond the initial free transfer shall require the purchase of a new subscription for the Bot.
  • 8.2 Management Discretion. Any additional transfers or overrides beyond the initial free transfer are subject to the sole discretion of Fraud's management. Such discretionary transfers shall not be construed as an entitlement to additional free transfers.
  • 8.3 No Liability for Server Termination. Fraud shall not be liable for any loss, damage, or inconvenience resulting from the deletion or termination of a User's Discord server by Discord or any other third party.
  • 8.4 Irreversibility of Transfers. Once a transfer of the Bot to a new Discord server has been completed, the transfer is final and cannot be undone.

9. THIRD-PARTY RELATIONSHIPS AND DISCLAIMER OF LIABILITY

  • 9.1 No Agency Relationship. Fraud does not have any affiliation, association, partnership, joint venture, or agency relationship with any Discord servers or communities that purchase or use our Services.
  • 9.2 Independent Actions. Users acknowledge and agree that Fraud exercises no control over the conduct, actions, content, information, or data of third parties using our Services.
  • 9.3 Disclaimer of Liability for Third-Party Actions. Fraud expressly disclaims any and all liability for actions, conduct, statements, or content created, posted, or otherwise generated by any Discord server, community, or individual User of our Services. Such actions and content are the sole responsibility of the respective User or server administrator, and not attributable to Fraud under any legal theory including but not limited to agency, partnership, or vicarious liability.

10. SERVICE AVAILABILITY AND TERMINATION

  • 10.1 Non-Guaranteed Availability. Fraud does not guarantee continuous, uninterrupted, or secure access to our Services. Operation of the Services may be interfered with by numerous factors outside of our control.
  • 10.2 Discretionary Service Provision. Fraud reserves the absolute right, in its sole discretion, to refuse service, terminate accounts, or remove or edit content if Fraud determines, in its sole judgment, that a User's conduct violates applicable law, threatens the integrity of the Services, potentially exposes Fraud to legal liability, or otherwise conflicts with Fraud's business interests.
  • 10.3 Right to Terminate. Fraud reserves the right, in its sole discretion, to terminate User's access to and use of the Services immediately without prior notice or liability for any reason, including but not limited to a breach of this Agreement.
  • 10.4 Survival of Terms. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. INDEMNIFICATION

11.1 User agrees to defend, indemnify, and hold harmless Fraud, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to User's violation of this Agreement or User's use of the Services, including, but not limited to, any use of the Services' content, services, and products other than as expressly authorized in this Agreement.

12. LIMITATION OF LIABILITY

  • 12.1 UNDER NO CIRCUMSTANCES SHALL Fraud BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM USER'S ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.
  • 12.2 THE TOTAL LIABILITY OF Fraud FOR ANY CLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY USER TO Fraud IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO SUCH CLAIM.

13. INTELLECTUAL PROPERTY

  • 13.1 All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Fraud and are protected by copyright, trademark, and other intellectual property laws.
  • 13.2 User is granted no rights or licenses in or to any intellectual property except as expressly set forth in this Agreement.

14. DISPUTE RESOLUTION

  • 14.1 Any disputes arising out of or relating to this Agreement or the Services shall first be attempted to be resolved through good faith negotiations between the parties.
  • 14.2 If disputes cannot be resolved through negotiation, both parties agree to submit to binding arbitration in accordance with the rules of a mutually agreed-upon arbitration service.

15. AMENDMENTS TO AGREEMENT

  • 15.1 Fraud reserves the right to modify, amend, or update this Agreement at any time at its sole discretion without notice to User.
  • 15.2 User's continued use of the Services following the posting of any amendments to this Agreement constitutes acceptance of those amendments.
  • 15.3 Violation of any amended terms may result in immediate termination of User's access to all Services provided by Fraud.

16. MISCELLANEOUS

  • 16.1 If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.
  • 16.2 This Agreement constitutes the entire agreement between Fraud and User regarding the Services and supersedes all prior agreements and understandings, whether written or oral.
  • 16.3 Fraud's failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
  • 16.4 The section headings in this Agreement are for convenience only and have no legal or contractual effect.
